Legislation being considered in Utah would create a new designation for “used” bedding. The legislation would require previously used products to be labeled as “used.” The bill exempts products returned within three days in their original packaging from this requirement.
Current law requires that used bedding be labeled “secondhand material,” but does not distinguish between previously used bedding and bedding made with secondhand materials. The bill also requires manufacturers, retailers and others to maintain sales or other records for one year on each mattress. It is unclear at this time whether the bill will advance.
